What Is Preferential Rent?

Preferential rent is a rent an owner charges a rent-stabilized tenant that is lower than the legal regulated rent on file for the apartment. Every stabilized unit has a legal regulated rent: the maximum the owner is allowed to charge, and the figure registered with the state. When market conditions or a particular tenant situation lead an owner to charge less than that ceiling, the reduced amount the tenant actually pays is the preferential rent.

Both numbers must appear in the tenant’s initial lease and in every renewal that carries the preferential rent forward.

How long a preferential rent lasts changed on June 14, 2019. Before then, an owner could withdraw it at renewal and move the tenant up to the full legal regulated rent, so it could vanish from one lease to the next. Under the Housing Stability and Tenant Protection Act, a tenant who holds a preferential rent keeps it for as long as they stay in the apartment, and every renewal increase is figured on the lower preferential amount using the Rent Guidelines Board percentages, not on the legal rent.

The legal rent does not disappear, though: when the tenant moves out, the owner may offer the next tenant up to the full legal amount, as long as the prior tenant did not leave because the owner failed to maintain the unit. Charging a sitting tenant above their preferential rent, or dropping it from a renewal, is grounds for an overcharge complaint to the state, which sets out the rules and the required lease disclosures in Fact Sheet #40.
