What Is the J-51 Tax Abatement?

The J-51 tax abatement is a New York City property tax benefit that helps owners of residential buildings offset the cost of major renovation work. It has two parts: an exemption that shields the added value of the improvements from higher taxes, and an abatement that cuts the building’s existing tax bill by a share of the certified cost of the work. 

It is run jointly by the Department of Housing Preservation and Development (HPD), which certifies eligibility, and the Department of Finance, which applies the benefit. After lapsing for work completed after June 29, 2022, J-51 was reauthorized by the state and re-enacted in New York City through Local Law 122 of 2024, a reformed version often called J-51 R.

The current program is narrower than its predecessor and tied to affordability. The abatement is capped at 70% of the certified reasonable cost of eligible work, set on a city schedule, and it covers projects completed between June 29, 2022 and June 29, 2026.

Eligible buildings fall into a few groups: rental buildings where at least half the units are rent-regulated at or below 80% of area median income, co-ops and condos assessed at $45,000 or less per unit, and certain Mitchell-Lama and government-assisted properties. Qualifying work is substantial rehabilitation, from roofs, facades, and heating and plumbing to the energy upgrades that help a building meet Local Law 97.

The strings are significant: to take the benefit, an owner records a declaration keeping the building rent-stabilized for 15 years, cannot also recover the same work through a major capital improvement rent increase, and must certify no recent tenant harassment. HPD can revoke the abatement or extend the stabilization period for noncompliance. HPD’s J-51 program announcement sets out eligibility and how to apply.
